This is good for the ACC renegotiation with ESPN
If an employee gets a competing offer, you reassess their market value and, in some cases, make a counteroffer. Phillips should bludgeon ESPN with this report: "guys, the B1G and Fox is willing to pay FSU, Miami, and probably a few others $80M per year! We need to be paid market rates or they will walk and the ACC network tanks as a result."

Disturbing, if true
I read a on couple of separate boards that The B1G will close their new media deal with just the current 16 known schools. They will then invite Cal, Stanford, Oregon, Washington and take that group to market as a separate package aiming for $250 million ($62.5 each). If that is the new protocol, how many ACC schools could score $100 million and how many score $62.5?

Disturbing indeed
Northwestern and Illinois will get $100 mil and Washington and Oregon will only get $62.5 mil? Beggars can't be choosers, I suppose, but that is a great example of how unfair all of this is. And should the ACC GOR come unglued, we'd all be glad to have that $62.5 mil. The question is: if Notre Dame decides to go B1G, would they get $100 mil or $62.5 mil?

But Warren had the nerve to talk about "equity" in his B1G media day
remarks. What a fraud. And BTW, you know ND will be getting paid IN FULL (with perks) if they go the B1G.

Key info is at the end
A source told the Action Network that the process of the Big Ten adding more schools could take "two months or two years" as the conference looks for further expansion. “Literally every Power Five conference school not in the SEC has reached out to the Big Ten,” according to the report. “University presidents, athletic directors, senior women administrators, you name it.” The two years comment caught my eye because that is not far off. Most likely that is just a hedge and news will come sooner. And if the last quote is true then it means some level at VT is working for our future. Personally I’m surprised that Miami was mentioned before UNC. But I’m sure reality is that the BIG has 10 schools on their immediate short list with different scenarios and combinations.

Why not claim they plan to take UGA and UF?

Exactly.....
This is the world of planting stories, fake stories etc. It's very underground and people believe anything in writing. The result is confusion panic and a response. Some leaks are crazy, some are planted by agents, some are true (very few).....

A lot of leaks are bunk! Stech 🤣

This is subterfuge to keep PAC schools from going to the ACC and that GOR
You ever hear anything about USC or UCLA moving before it happened? Nope. The B1G will end up with Stanford, Oregon and Washington (maybe Cal) by 2030-2031 but they don’t want that pesky GOR getting in the way. Those schools might be better off financially in the ACC in the interim but things like this could keep them in limbo until ND 💩’s or gets off the pot.

Plenty of realignment moves have been leaked in the past.
I read about many of them on this board before they were official, including VT's move. I do feel that the SEC and B1G have landed some sucker punches of sorts with their last moves. But, EVERYBODY realizes now that the mad dash to one of those P2 spots has begun. Gonna be a lot of jockeying for position. That also opens things up to more and more leaks. Pretty much every P65 school is now involved in this thing. That's a lot of people to keep things quiet.

This is what needs to happen in order to get the 8 ACC dissolution votes.
Keep the leaks coming. It will get the SEC moving forward. SEC would be crazy to let the B1G into Florida. Additionally, they would be crazy to let them into Georgia or SC also. Overall, it makes me feel better about VT's place in one or the other relevant leagues. The NC and Virginia markets are just too valuable. This would also mean that at least 8 ACC schools will have found a home. VT's gotta be one of them...i think. ** Edited by BBBDatVT at 7/28/2022, 5:28:04 PM

You mean 75% of the 14 right, posters below are saying it's 75% which is 10
to dissolve the conference. If so, that is a very high bar to reach.
B
BBBDatVT
I disagree. i think the number is 8.
That's especially true if that 8 includes the likes of UNC, Clemson, FSU, etc... You really think the other 7 are gonna be able to force them to stay? Where's this gonna go to court? North Carolina? ** Edited by BBBDatVT at 7/28/2022, 6:35:12 PM

Just telling you a couple of reliable posters said it’s 75% to dissolve ACC
They said they read it in the bylaws.

I don't consider the Greensboro Country Club apologists reliable.
I know you were all in on the stuff that those guys were spewing for years, at the expense of VT. But i honestly cannot fathom any true VT fan continuing to believe anything that comes out of the mouths of anyone who was affiliated with the old ACC regime. I had been optimistic about the new regime BTW, but that press conference Phillips delivered was the worst I've seen...outside of Whit Babcock and a certain former POTUS. Anyhow, Phillips was dealt about as bad a hand as possible when he took over anyways. Not sure there was much the guy could have done differently. He's saddled with that atrocious GOR and ESPN contract. ** Edited by BBBDatVT at 7/29/2022, 10:12:09 AM

Any litigation over this issue would likely take place in Greensboro.

here you go; from the ACC Bylaws/Constitution
Here are the basics... "1.6 BOARD VOTING REQUIREMENTS 1.6.1 Quorum. Except as provided under applicable law, this Constitution or the Bylaws, two-thirds (2/3) of all Directors present at a meeting of the Board shall constitute a quorum of the Board; provided that, in the case of any matter requiring the affirmative vote of more than two-thirds (2/3) of all Directors present, a quorum shall only exist if at least that number of Directors equal to such required vote is present. 1.6.2 Required Vote. Each Director shall be entitled to one vote each. Except as otherwise provided herein or in the Bylaws, if a quorum is present when a vote of the Directors is taken, the affirmative vote of a majority of all Directors present for such vote shall be an act of the Board. For the avoidance of doubt, all references in this Constitution or the Bylaws to the affirmative vote of: (a) a majority or two-thirds (2/3) of all “Directors present”, shall mean a majority or two-thirds (2/3) of all the Directors who are present at a Board meeting at which a quorum exists; (b) two-thirds (2/3) of all the Directors, shall mean two-thirds (2/3) of all the Directors of the Board, even if one or more of such Directors is not present for such vote (“Absolute Two-Thirds Matters”); and (c) three-fourths (3/4) of all the Directors, shall mean three-fourths (3/4) of all the Directors of the Board, even if one or more of such Directors is not present for such vote (“Absolute Three-Fourths Matters”). The Absolute Two-Thirds Matters are as follows: (i) any amendment to Article 2.5 of the Bylaws (Finances), (ii) selecting or changing the location of the Conference office, (iii) entering into or amending any Material Media Rights Agreement (as defined in Section 2.3.1(q)), (iv) the appointment, extension of the term, or removal of the Commissioner or the other matters set forth in Section 1.5.2.1.1, and (v) the initiation of any material litigation involving the Conference (but not, for clarity, the settlement of any litigation involving the Conference, which requires the affirmative vote of a majority of all Directors present for such vote). The Absolute Three-Fourths Matters are as follows: (i) the admission of new Members to the Conference pursuant to Section 1.4.3, (ii) the expulsion, suspension or probation of a Member pursuant to Section 1.4.4, (iii) any amendment of this Constitution, (iv) any amendment of the Bylaws (except amendments to Article 2.5), and (v) waiver of notice or other required process for a Board meeting pursuant to Section 1.5.1.5.2. 1.6.3 Constitution and Bylaws Amendments. The initial draft of any proposed amendment to this Constitution or the Bylaws shall be submitted in writing to the Directors or their designees at least four weeks before the Board meeting at which such amendment shall be considered. Revised drafts reflecting material comments received within 14 days shall be sent to the Directors at least 10 days before the meeting; provided that motions for further amendments may be considered and adopted by the requisite vote at the meeting." I think that as a practical matter, if a majority, including all the significant football programs, want to leave that the conference might decide to fold. But to do it formally and not spend quite a bit in monetary damage awards they'd need to do it via the rules above. ** Edited by daveinop at 7/29/2022, 6:49:14 PM

Thank you -for your insight these are legal documents
On these factors of realignment so many experts and really no experts in corporate law… Facts- acc has by laws and member schools - approved by their board of trustees - its a contract; and if it 1) does not have a condition of being dissolved; it is what it is. 2) if a new bylaw for anything requires 75 percent membership it is what it is and 3) if grant of rights not a by law but an action then takes a majority vote to void the gor. However all that does is void the espn contract and makes the conference more financially shaky . Then if any member wants to leave this results in messy court settlement because there is no by laws for this. I think the sec and big ten are reaching out to their candidates however they know the acc structure. Espn sorta stuck as well in the acc contract. Therefor i see the tactic to box the conference in- starve them in media coverage for 15 remaining years and only the strong survive. Best tactic for acc members - raise your own money without espn guarantees and win. Vt miami fsu and clemson wins again and top 15 programs consistently and beat their ooc games. Others will fade away - gt duke maybe cuse and bc and even wake

Thanks, but it is not my insight, it’s what HOO86 said below, search his

hey good UVA lawyer
I always said that the ACC bylaws and and Grant of Rights were written by UVA, UNC and Duke attorneys... some of the best in the business...... (not some 2 bit lawyer named "better call Saul) grin

Constant reports like these will just fuel the dissolution of the PAC-12
The four corners schools in that conference will head to the Big 12 sooner than expected if there's an inevitable sense that the Big 10 is going to take some of the inventory eventually. Plus, the remaining PAC 10 schools are going to end up with less than $30 million a year in TV rights money. The four corners schools can do better in the Big 12 than that. I could see the PAC 12 imploding in less than a year.

I don't know...I'm hearing the ACC is about to raid the SEC. TIC
B
BBBDatVT
i think the ACC has less than a year, UNLESS ND and/or ESPN bails them out.
I'm skeptical that they will. As another suggested, there is zero chance FSU, Clemson, or mIami are gonna sit on their sit on their hands for the next 14 years.
1
133743Hokie
No one is going to test the GOR in the next year at a minimum
B
BBBDatVT
i think the length of the GOR works against it.
Clemson, FSU, and even UNC and UVA realize that they ABSOLUTELY CANNOT compete if they are that much in the hole for 14 more years. They've gotta make a go at it sometime. They're behind by tens of millions of dollars each and every year. You can't just write that off
M
Mercury
And how do explain the GOR
Almost every legal expert says the ACC GOR is solid. Right now today, for a team to leave would cost 500 million a team. More power if they want to write check. Also, there is separate transitions cost for leaving the conference other than the GOR.
1
133743Hokie
More like $1B+ over the term of the GOR
B
BBBDatVT
Easy, the conference dissolves, or at least will be in the process in a yr.
I'm not buying the super majority being necessary. I think the B1G and SEC will open up at least 8 spots for ACC members. That's all it's gonna take.
1
133743Hokie
Gonna take 10 or 11, 75% of membership. Good luck

It’s very possible Louisville and Pitt go Big XII
They aren’t going to the SEC or the B1G. They might want to secure their future in the northeast of the 3rd Power Conference. 10 and 11 could come there. ** Edited by hokieZ71 at 7/28/2022, 8:07:23 PM

Totally disagree. no way that holds up with 8 members wanting to leave.
And again, that's especially gonna be true if the NC schools are part of that 8
