Eye Roll. ===================================== NIL collectives abandoning deal clearinghouse, preparing for transfer portal spending by: Pete Nakos As the NCAA works to finalize dates for the college football transfer portal, NIL collectives are preparing for more unregulated spending this winter. A handful of third-party collectives have begun to bypass the NIL Go clearinghouse, sources told On3. But sources have told On3 that it is only a starting point. Front Office Sports reported on Wednesday that at least two NIL collectives are paying players before deals are approved. An ACC NIL collective told On3 on Wednesday that while only a few have bypassed the clearinghouse, there is another group ready to make the jump. “I have a deal valued at over $20,000, and if they don’t move on the deal soon, I’m never using the system ever again,” the source said. “Nobody has had a productive conversation with them yet.” So what is actually happening? A handful of NIL collectives have begun circumventing the College Sports Commission (CSC) and NIL Go system – which, according to the House v. NCAA settlement, is supposed to review every third-party NIL deal valued at $600 or more. Since the start, collectives have been skeptical of the clearinghouse. This summer, the CSC released guidance that would have handicapped the donor-led organizations, which was later walked back. Similar to NCAA rules, pay-for-play deals are not allowed, and the CSC was established to execute rules, including possible eligibility consequences. “The rules created by the House settlement around third-party NIL deals are actively in place and enforceable and apply to all current NCAA Division I student-athletes,” the CSC told On3 in a statement. “Pay-for-play deals are not allowed under the rules and will not be approved in NIL Go. There is no safe harbor for breaking these rules and there will be eligibility consequences for student-athletes who do not follow them.” But that has not slowed NIL collectives from operating in the shadows. Sources have told On3 that multiple NIL collectives are prepared to pay out cash come January when the transfer portal opens to retain and acquire talent. “Plenty of schools will be ready to pay before the portal opens,” a collective told On3. “Rev-share is just the new floor of paying athletes. At this rate, the system is going to be killed by Christmas.” The College Sports Commission released data in September, sharing that a total of 8,359 deals have gone in the system to date, which have a $79.8 million total value. NIL Go cleared 6,090 deals out of 8,359 total entered into the system, and the total value of cleared deals is $35.42 million. Collectives circumventing the CSC is only the latest in the saga between the two parties. When deals were slow to process this summer, collectives told On3 that they were preparing to file lawsuits. To this point, no lawsuits have been filed. “Who are they to determine what a valid business purpose is? If they really want this thing to work, they need to approve more than they deny,” an SEC collective previously told On3. “They need to give everybody some grace and not be iron-fisted. “Not to say the quiet part out loud that we’re trying to kill collectives. They just provided the opening statement for the first lawsuit against them. That you’re going to treat people differently. Or people are going to start paying under the table, or kids aren’t going to submit deals.” Sources have told On3 that the free agency window in college football could be “bonkers” as some schools work to follow the CSC rules and send deals through the clearinghouse. Meanwhile, others could be taking steps to circumvent NIL Go, offering dollars that are not tied to rev-share that would not be put through the clearinghouse system. Earlier this week, On3 confirmed the CSC is establishing an anonymous tip line, which has been nicknamed as a “snitch line” by some in the college sports industry. The CSC will be taking tips on everything from schools going over the cap to circumventing NIL Go. But even the threat of having peers call out NIL collectives that bypass the clearinghouse is not slowing down collectives. “Cash is going to be promised out in January, and that’s how teams are going to put together winning rosters in 2026,” a source said.
