Texas Tech is doing something that is very plainly wrong, not in good faith, and not in the best interest of the sport, and they are doing so by hiding behind this state court judge's ruling. They may not have been a party to Sorsby's lawsuit, but you're naive if you don't think they encouraged it, and even more naive if you don't think the Texas Tech football program wasn't first and foremost in the judge's mind in considering the request for the temporary injunction, whether he was a TT alum or not. I know a lot of people from Texas, and the Texas mindset, whether you're from Fort Worth or Nacogdoches, is that nobody from some other pansy state is going to tell a Texan what to do, and I'm sure that exact thought was front and center in the judge's consideration of the merits.
So, I hate to tell you, but Texas Tech is just as complicit in this BS as Sorsby is himself.
Let me provide you some additional context here, and you can take it for what it's worth:
I have previous experience working with multiple state circuit court judges (not in Texas, in multiple eastern seaboard states.) I will tell you this - some genuinely care about correctly applying legal principles and not getting overturned by a reviewing court, and some feel their judicial appointment is a license to do whatever they want based upon what they think the outcome should be, and could not care less about whether their decision is appealed or ultimately upheld - to them, that's someone else's problem. I have been a practicing attorney now for over 20 years, and this judge's decision was laughably poor and demonstrably wrong, even to a 1L law student with very little concept of remedies - there was ZERO irreparable harm to be found in this case. Money damages could have made Sorsby whole had he ultimately been successful on his claims. This was clearly a judge that had a preferred outcome, made his ruling, and just tossed up a word salad to explain himself. He's a retired judge as well, so I'm assuming he couldn't care less if some appellate panel overturns his decision, especially since the claims will be moot by the time it comes up for appeal.
