You would not make it as a lawyer, too much truth
1st point. What you just said, FSU is saying we signed a GOR happily giving the ACC the right to negotiate as they did, we were ok with the deal and have collected lots of $$$. There was nothing wrong with the contract, which if they didn't review it, that is on them. There is nothing unique with the GOR that they didn't know at the time they signed it. All that stuff FSU is blowing smoke about is just that stuff. The only real point is the ACC did not keep up with the P2 but that is an unreasonable point because as of right now, of the former P5, the ACC is right in the middle. So there is nothing, nothing at all to all the complaints against the ACC's management. Certainly not as good as the SEC but that is different.
Then there is the "snub" What did FSU reasonably expect the ACC to do? The media set the matchups and no matter how much Jim Philips took to the mike, it would have made no difference, It was not the ACC, it was the networks who really engineered the snub.
They have only one point, "IT'S NOT FAIR, WE DESERVE MORE." wah, wah, wah!!!!! Yes they are right they are worth more in todays market. But, they signed a contract (the GOR) and what they are really asking is to throw all rules and protections for every other team out and just do what is best for them at the moment. To them, the only rule is what is best for them at the moment and in the next moment something different happens then today's contracts are worthless because they are no longer
best for FSU.
2nd point, You got this one dead wrong unless there is an as yet uncovered covenant in the contract in which the ACC pledges any recovery back to ESPN. The one snippet of the contract that on this, Clemson and FSU tried to twist is on in which ESPN says they are under and will take no obligation to collect once a team leaves. Then you are right again, what these "rights" are really worth is the big question. But in the end, if a court upholds the value, then the ACC may just file a judgement and levy against any FSU asset if FSU bucks the payment.
Again on the last point, we agree, ESPN owns the ACC, Big 12, and the SEC and FOX owns the Big because what they control is the pipeline that carries the ability to earn $$$$. Without that pipeline none of the brands, teams nor conferences are worth much at all.
