choice regarding whether to break away or not. Remember up until 1991 DI schools could compete in DII and DIII for a sport or two. Most DI schools who opted to go that route did it for football to try to save money. The primary reason the DI schools changed its bylaws is because enough schools thought the DI schools competing at the lower level had an unfair competitive advantage over their DII or DIII peers. Enough schools believed the "advantage" came in the form of the program having access to the other DI resources that weren't available to the DII or DIII schools. If the P2 schools end up treating all their athletes as employees, then a similar argument (maybe even the same argument) could be made if any DI sport ends up in the situation where you have employees competing against student-athletes. Right now the P2s are probably the only group of schools that can afford treating all their athletes as employees. Whereas the remaining DI, DII, DIII, NAIA, JUCO, and Community College schools may only be able to afford to reclassify the athletes in a couple sports at best as employees. Even if the P2 agree to continue treating certain sports as student-athletes, those program will still have access to resources that are currently available to the employees. The accounting is too messy to ensure there is a clean separation in the pots of funding (employee pot vs. student-athlete pot) particularly since historically the non-revenue sports depend on the revenue sports for funding.
