They could set it up, and just not give them the money up front,

and pay them the amount that would have happened without the deal. It wouldn't be difficult to run the numbers. The rest of the BIG get more money up front, but pay a slightly higher % in future years. I don't know if there is an opt out, but there should be. In fact, if there is an optout for individual schools, the B12 and ACC might sit down and listen to proposals.
