It may not be that much different than in the late 70s the DI schools

decided to create 2 subdivisions for football. A few schools (i.e. Richmond was one of those schools in that group) tried to sue to remain in DI-A because they thought their athletics would "suffer" if they were "relegated" to DI-AA. Eventually everything was settled in '85, '86, or maybe '87 with those schools agreeing to be "placed" in DI-AA. I don't remember what the schools got out of the settlement for going along with the plan, but I am assuming it was something.
