this is not political, its sound law decisions
1. NCAA was organized as a non-profit entity whose intention was student athlete. College agreed to join it- not becuase of some financial gain, but the merits of the goal, and agreed to follow the rules. HOWEVER
2. WHen TV rights came in and big money was introduced, the money and sucess was limited by NCAA rules and enforcement. THe NCAA culture and institutions were shocked by push back by some programs, who introduced attorneys to challenge every policy in the NCAA. (NCAA still amazed why?? its for the student athletes).
3 Finally, all recognized this is business, and NCAA has no legal authority to regulate the business, so they are left with platitudes and serve as a great host for NCAA championship events.
4. So this says Congress and federal regulation. Sounds good on paper however, these colleges have huge number of alumni (fans) who are passionate. THe elected officials from both parties hate a noisy consitency. If any law that 1) affects the profits of the athletic dept (ie, remove tax exempt category) or regulates the programs ablity to win championships, those elected officials will get the rath of hte voters. (this includes most of the Sunbelt and midwest and Big 10 area.
