If they feel it doesnt rise to that level, then so be it. But what they can't do is modify an arranged agreement to where he is both required to work, but do so for free. There's not an employer in the world who has such a policy in place without a written agreement to do so...and shame on any lawyer who would agree to such a terrible deal for their client if one exists.
