fsh, I love this post. Let's look at it a little closer, and how it
relates to AthDept administration. It's outside the box thinking, and that's why I like it. And, it's probably, IMHO, doable, if they want to do it (the operative word is "want,"). And, I'll assume they could get 10,000 of 25,000 donors to participate. Your distribution of the proceeds I'll leave to others to argue.
First, if such diversions were to occur, then I'm assuming those diversions would be to either the HC and.or the Keep Jumping Fund (as per the recent Investment Guide). That would then mean that these funds are handled by VT, and thus publicly available for review. i.e., FOIA, request to VT Hokie Club. That would also mean disbursement of said funds would be publicly available info. I personally love that, and might diminish my reluctance to give NIL money. That would also mean I could discern what the overhead costs of NIL are, and who is making the decisions on who gets how much. I love that. Also, I like your comment regarding making donors participatory shareholders, vice silent partners. That EOY meeting is pure gold, and definitely needed.
I'm not sure about that $250,000 ceiling. I don't dislike it, I'm just not sure if it's legal. That might have to be negotiated with the players, if collective bargaining ever occurs. As far as those few who would exceed the $250,000 ceiling, I'm not sure how that would affect portal entries. Unless other schools were doing the same thing, a player making above the $2.5K ceiling could retain more of his NIL by going to a school who matched VT's NIL but wasn't making him/her pay his/her way through school.
Others on here have predicted that points for NIL donations would be given points by the HC for such donations. It's doable now, with the stroke of a pen. But, that assumes the HC is receiving the money to start. And, although I'm being admittedly redundant, that means those donations and disbursements would be publicly available, or as I call it "FOIAble."
I believe your plan would be doable, having not read the new state law re: NIL that took effect this past summer. We've been waiting for months for implementing rules by the AthDept re: this new state law, but have seen or heard nothing since its passage was announced with much fanfare.
I too trust @Will Stewart and TSL more than the HC, much as I trust SERTC and @VTChip more than the HC. I just don't think Will has the desire or inclination to do it. Now, all that being said, I don't know if your post was meant Tongue in Cheek, but if not, I don't want you to think I'm being snarky in my response. If it was meant Tongue in Cheek, then I'm playing your fool. Laugh's on me.
What I like re: your proposal is, it has, by it's nature, transparency and accountability. Do I think it will happen, No. Do I wish it would happen, yes. Thanks for the post.
