I would just do it on winning percentage, not TV ratings.
And the schools would need to play the same 12 teams. In other words, only play regular season games in one's own regional tier. The competitiveness of such a model would drive its own higher TV ratings and the sport could then advertise itself as handling things "on the field". No conference dead weight (Northwestern, Rutgers, Vandy, et al.) and no NBA- and NFL-style tanking.
It wouldn't hurt the system if a Boise State was promoted for one year to the Top League. While maybe a Nebraska was relegated for one year.
