NIL/employee status is being decided in courts, not by schools/conferences

Unless you are compensated for it, NIL belongs to everyone; in and out of sports. The courts will also decide if athletes are students, employees, or both. Money is changing hands, there are expectations associated with that, etc. Sounds a lot like an employee to me. The schools and conferences via the NCAA have tried to control all of it; but when they started making big money, it became obvious that athletes would challenge the system. The NIL decision was a no brainer and I don't think the court rulings on any other aspect of this have really surprised anyone. If any school, public or private, is going to make a pile of money off of their athletes, students, or employees, those people are going to have to be compensated under some type of contractual arrangement. And since professors can make money (sometimes big money) on the side, as many do, it is going to be really hard for a school/court to say no to the students.
