Why should Title IX exclude football?
Majority of the time whenever I hear someone trying to answer that simple question, the only defense I hear is "there is no women's sport that offers the same number of scholarship opportunities as DI football (FBS and FCS)." The only response I have to that defense is "Who's fault is that?" Since the law doesn't define what is considered to be the " minimum college experience" and it even gives the schools the Three-Prong Test to comply with the law, the numbers defense becomes that much more weaker IMHO. Then when you look at what currently exist at the DII level, it only reinforces that the schools are squarely to blame for not being more proactive over time to provide women the same opportunities they gladly provide men.
DII Football Caps
Squad Size: 53 equivalent scholarships
Bench Size: 125
Definitions
Squad Size - Number of student-athletes in uniform who are permitted to compete in the NCAA championship.
Bench Size - Number of individuals who are permitted to sit on the bench. This number can include the squad size, coaches, administrators, team personnel and other student-athletes not participating in the competition.
If enough people truly believe that Title IX should explicitly exclude football from the calculation, then they have the power to convince enough people in Congress to amend the law. Otherwise, it is up to the schools to find ways to increase the number of opportunities given to women by either adding more sports to the sponsor list or increasing the scholarship limits on the sports currently on the sponsorship list to offset football. If that isn't an option for whatever reason, then the only other choice is take a hard look at whether it makes financial cents (or sense if you will) to continue with the mindset that DI-FBS football "needs" 105 full scholarship players on the roster and DI-FCS football "needs" up to 63 equivalent scholarships + 20 walk-ons on the roster.
There is a huge difference between "want" and "need." It would not surprise me if the schools and the American culture has been operating under the mindset that collegiate American football "needs" to have extremely large rosters to function when in fact it has always been a "want." If you truly want something bad enough, then you should be willing to pay the price tag. In this case the "price tag" being required to make sure women's collegiate athletic opportunities aren't sacrificed because the American society is considered to be a patriarchal society. At least the argument could be made that western society on a whole, which gave birth to the American society, was established largely on patriarchal principles.
