I really think the pieces are in place for this NIL stuff to implode.
There’s no Mercedes dealership gonna pass out G wagon leases for an entire recruiting / portal class even in Austin or College Station.
At some point there’s no squeal left in the pig and imo we are rapidly approaching that threshold. We’ve gone from trying to put some much needed funds into deserving young athletes to a mini-draft w significant signing bonuses.
This has serious tax implications - at least to me. If the dealership is writing these lease (loss) costs off, what is the tax treatment of that vs what the dealership got from the school? If the lease value is > $15,000 ($17k might be the new cap) per year who is paying the gift tax above that amount? Is the lease value viewed as income since it is being paid/given the lease amount? Insurance and maintenance - who is paying that.
Need a tax guy on here to detail “how” the government could treat all parties.
