I won't profess to understand all of (i.e. any of) the labor law. I find

parallels in discussions that are currently taking place with graduate students regarding their compensation. When I was a student (during the Dark Ages when oil lamps were still being used), stipends were viewed as being compensation that is paid for services while students received training. The training itself was viewed as part of the compensation, but there was not an expectation that students with families could support them entirely on the stipends. (Hence the many stories that exist about spouses supporting the families during those periods.) Now, there seems to be an evolving (or evolved) expectation that stipends provide "a living wage." It's perhaps not surprising this has occurred: the cost structure for a graduate education has changed considerably since then. I now hear many students asking to be treated as employees with benefits comparable to other employees of the institution. I understand some of the mentality (I've worked with students outside the US where they work as and are treated as professionals while they are completing graduate degrees). But I feel that the students no longer see as much value in the education/training as I did. (I've not yet seen that with my own graduate students, but I fear it is just a matter of time.) I feel similarly about the student/athletes: for many of them, the focus has moved away from the benefits that come with being a student and just to the immediate dollar.
