What would be the argument to justify it being allowed when restraint of

trade has already been established as a common law doctrine? It will likely take more than "We want it that way" to pass the various tests the courts use to determine their ruling. Currently the pro leagues have salary caps for players because of the CBA between the owner(s) and the players. However, there is no regulation on how much each owner is allowed to spend for non-player related expenses. Likewise, there are no laws, rules, or regulations that limits how much money an entity can spend on employee expenses and non-employee expenses.
